VIRGINIA BEACH, Va. — Police have arrested a Virginia Beach woman for child abuse after a 4-month-old child was found not breathing at her unlicensed in-home daycare.

Marlene Gail Rice, 48, has been charged with one count of abuse and neglect of children after the baby’s death on August 15, according to WTKR.

Police and EMS responded Rice’s home in the 800 block of Levy Loop for a medical emergency.

When paramedics arrived, they attempted to resuscitate the baby but were unsuccessful. The infant was pronounced dead at the scene.

Investigators discovered that the person who called 911 was operating an unlicensed daycare out of her home. According to police, there were more children than were legally allowed to be under her care at the time.

After further investigation, Rice was arrested.

Police say the incident is still under investigation.

Rice is scheduled to appear in court Wednesday, August 31.
