HENRICO COUNTY, Va. -- A Henrico Judge on Tuesday dismissed the charges against a man convicted of infected sexual battery.
Daniel Cleaves, 28, who is HIV positive, was charged after having sex with a woman in 2013 without disclosing the fact that he has HIV to her. The charge was dismissed due to a one-year statute of limitations on misdemeanors.
Cleaves lawyer asked that the conviction be set aside and a Henrico Circuit Court judge granted that request Tuesday.
Cleaves was convicted on December 15, and ordered to serve one year behind bars in the Henrico County Jail.
In 2015, Cleaves was also convicted and sentenced to 18 months for similar crimes in Maryland. He has received a five-year prison term with all but 18 months suspended.
The judge in Maryland also ordered him to stop having unprotected sex.
Fatima Smith, the YWCA Richmond director of community outreach and public education said women who have come into contact with Cleaves have resources that are only a phone call away.
“We do offer counseling services 24 hours a day, 365 days a year,” Smith said. “It gives them an outlet to turn to whether it happened five minutes or five years ago.”
