HENRICO COUNTY, Va -- The Ottney brothers were simply heading to their local convenience store to grab a few things, losing a wallet, wasn't in their plans.

"I walked in and I realized I had no way to pay for anything and I said, oh I just dropped my wallet" said Dave Ottney.

He and his brother searched the store parking lot at Three Chopt Rd. and Pemberton to no avail so they moved their search back to Dave's driveway at home but the wallet wasn't found.

Dave explained what happened to the stores owner and was surprised a few days later to get a phone call from him, saying he knew what had happened.

The owner had gone back and watched surveillance video of the parking lot and Dave's brother Daniel said it's clear what happened "My brother as he is getting out, he's going to drop his wallet" he said.

"Then the video shows the driver parked beside him he spots the wallet, makes and athletic move behind his door, picks up the wallet and gets back in his car," said Daniel.

Dave called Henrico County Police who came and watch the surveillance video and then track down the 63-year-old driver who admits he picked up the wallet.

In fact, he still had it and handed it over to police and they give it back to Dave, who has canceled his debit and credit cards but is happy to retrieve his driver's license.

Dave said he was told by police no charges will be filed.

"I think it's horrible, I mean, this guy obviously took that wallet on purpose, looking for cash," Dave said.

Henrico's Commonwealth's Attorney Shannon Taylor said Tuesday afternoon, the matter had just been brought to her attention.

Taylor said she has spoken with the investigating officer and with Dave Ottney. She is now in the process of getting a copy of the surveillance video and upon receipt and review of the video and the facts of the case, the appropriate action will be taken.
