CHESTERFIELD COUNTY, Va. -- The Amelia man who pointed a handgun at a family waving Confederate flags on Hull Street Road during an altercation in July will spend one month in jail and pay a fine. James Baker, 46, who was found guilty of brandishing a firearm, was sentenced to 12 months in jail with 11 months suspended. He was also ordered to pay a $150 fine.
Baker's attorney told WTVR CBS 6 News his client planned to appeal the judge's ruling concerning the class one misdemeanor.
Mark Wilson, whose family stood outside waving flags on Hull Street Road outside their Moseley home, told WTVR in July the incident was scary.
"He slammed on the brakes and when he got right beside me, he pulled out a gun, chambered a round and told me my cause wasn't worth anything now," Wilson said. "He got out of the car and took three steps towards me and the gun was maybe six inches off my head."
Wilson said that when Baker eventually got back into his car and drove off, they called police.
"They found him in Amelia and he said we were threatening his life," Wilson said. "This is a busy highway and he is in a vehicle going 70 miles per hour, how are we threatening him by walking across?"
The Wilson family said to them, the Confederate Flag is about heritage, not hate.
"We just don't believe our flag means that we're racist," Wilson said.
