Bob McDonnell does not go to jail as SCOTUS mulls whether to hear case

WASHINGTON, D.C. — Former Virginia Governor Robert McDonnell was expected to report to prison soon, as early as August 27.

But on Monday the Supreme Court of the United States stated that McDonnell could remain free until the court determines if they will hear his case.

If they hear his case, the stay shall terminate upon the issuance of the judgment of the Court. If they decided not to hear his case, the stay terminates automatically.

Legal analysts said that it is “very rare” that the court would grant such a request and said it could be seen as an encouraging sign for McDonnell.

One week ago, an order issued by Chief Justice John Robertsstayed the recent ruling of United States Fourth Circuit Court of Appeals, which had ordered McDonnell to report to prison within the next few weeks.

McDonnell was convicted last year of accepting gifts and loans in exchange for political favors, a conviction he has appealed twice.

It could be months before SCOTUS decides. Typically it takes four justices to grant the petition, and fewer than 100 cases a year are heard by SCOTUS.
