Attorney for Martese Johnson is asking for case to be thrown out

CHARLOTTESVILLE, Va. -- Daniel Watkins filed a motion Friday saying that ABC officers lacked reasonable suspicion to make an arrest of his client Martese Johnson.

He says his client was pushed to the ground after pulling his elbow from the grasp of one of the ABC agents -- who tried stopping Johnson from walking away while he was being questioned on March 17 outside of a Charlottesville restaurant.

Watkins also claims one of the agents involved in Johnson's arrest was also involved in the controversial arrest of another University of Virginia student Elizabeth Daly.

Back in April of 2013, ABC officers charged her with assault when they tried to stop her for underage possession of beer -- that beer turned out to be sparkling water.
