Lawyers for Hanover doctor cites accuser’s ‘troubled past’

HANOVER COUNTY, Va. — A judge ruled on a number of motions filed by defense attorneys for the Hanover doctor accused of sexually assaulting one of his former patients.  Dr. Brent Logie had no comment as he and his wife left the courthouse.

The family physician is accused of sticking his hands down the front of a 23-year-old woman's pants twice during a Christmas party at his Hanover home.

His accuser was once a patient.

"He's holding up.  But still it's a lot of pressure," defense attorney Michael HuYoung said.

In court Tuesday  HuYoung tried to discredit the woman's testimony. He presented court documents that showed the victim has two prior misdemeanors convictions.

In 2011 the accuser was arrested and charged in Henrico for possessing a false identification. One year later police in Harrisonburg charged her with Underage Possession of Alcohol.

Logie's attorney argued alcohol has had an influence in the accuser's life. He said she was drunk on the night of the alleged incident.

"She may not be fabricating, but she may have misperceived what happened," HuYoung said. "If you're intoxicated sometimes you think something happened that didn't."

The judge ruled he would allow jurors to consider the victim's false ID conviction, but held off on making a decision allowing evidence of previous alcohol use.

The judge also ruled the defense could only reference Dr. Logie's job status -- he is currently on leave -- during closing arguments.

Logie's trial is scheduled for October.  He is charged with two counts of Object Sexual Penetration by force.
