HANOVER, Mass. (CNN) -  A mall Santa appeared in Massachusetts court Monday accused of pinching a female co-worker's backside. Police said Herbert Jones, 62, was dressed as Santa over the weekend when the woman complained about the mall Santa's actions.

The woman was crying when she reported Jones to police, the police report indicated. It also said the woman told police Jones had made suggestive comments in the past.

"I wish you were a few years older and I was younger," she told police Jones said.

Jones called the woman's allegations untrue and said she was the one who brushed up against his hand. He added he quickly pulled his hand away.

The judge allowed Jones to return home after Monday's hearing, but ordered him not return to work as Santa this season.

Jones is due back in court Christmas Eve.
