CHARLOTTESVILLE, Va. (WTVR)--The family of Morgan Harrington is announcing a lawsuit today, saying they're going after the security company at the John Paul Jones arena in Charlottesville.

Harrington is the Virginia Tech student who disappeared, after she wasn't allowed to re-enter a Metallica concert in October of 2009. She was found dead in a field several weeks later.

It's presumed she was kidnapped -- and police have never solved her murder.

In the lawsuit her parents, Dan and Gil Harrington said their daughter suffered a serious cut to her chin and was heavily bleeding. The lawsuit also says that a witness saw Morgan Harrington acting disoriented and confused.

The lawsuit claims security was negligent because after she left -- she was not allowed back inside even though she was injured and not dressed for rainy conditions.

The initial lawsuit sought $3.5 million against the security company.
