HENRICO COUNTY, Va. (WTVR) – Charges against a Henrico teenager once accused of shooting a fellow teen at a West End house party have been withdrawn.

In an email, Henrico Deputy Commonwealth’s Attorney Nancy Oglesby said a ballistic report received two weeks ago showed that there were two guns fired the night of the party. As a result, the case against Marcus Moore, 19, was withdrawn in Henrico Juvenile and Domestic Relations District Court.  The case is still under active investigation, she added.

In a September interview, Moore said he was not guilty of the shooting that injured a teenage girl.

“Totally innocent,” he said. “I’m sorry that it happened to her and hope that they do find whoever did it.”

Police charged Moore with Aggravated Malicious Wounding and Use of a Firearm In Commission Of Felony after he turned himself in following the shooting.

Witnesses who attended the September 1 party along the 11000 block of Hilbingdon Road in Henrico said trouble started when a group of teenagers showed up at the party and started to steal from the house.

“They were giving high fives and then all of the sudden, iPhones were gone and it was crazy,” said one party goer who wished to remain anonymous.

The shooting started at some point after the group was asked to leave the house party, witnesses said.
