Henrico healthcare contractor hits roadblock trying to get final paycheck

HENRICO, Va. – A Henrico woman contacted CBS 6 Problem Solvers and said that her former employer had not paid her for work done more than five weeks ago.

The woman, who did not want to show her face on camera, is a physical therapist from a home health care company.

She said this would have been her last check at that company. She turned in her equipment and on a few different occasions tried to get the last check, but to no avail, she said.

After a few months at the job, which was part time, she picked up more hours at her full time job and decided to leave the company.

When she went back later to get her paychecks, she was told two checks were ready, but not the third.

Then she went back to get the third and was told the person wasn’t there.

She showed us records that she tried to contact the Department of Labor, but she had not made headway.

According to CBS 6 legal analyst Todd Stone, she’s right about the red tape.

In Virginia, workers who are listed as contractors and have trouble recovering money from an employer face different rules than other employees.

The CBS 6 Problem Solvers contacted the company on behalf of the woman, and the owner explained they've had the woman's check since early September.

They said that the woman never agreed they could mail it to her.

Ultimately, they allowed CBS 6 to deliver the check, with the former employee’s written permission.
