Morrissey files lawsuit to get on Democratic ballot

RICHMOND, Va. -- Former Del. Joseph D. Morrissey filed suit in Richmond’s Circuit Court Monday asking for a preliminary injunction to prevent printing the ballots until “he and the wrongfully excluded petition signers get their Constitutional right of due process and equal protection.”

Morrissey, who is seeking a run for the 16th District Senate seat as a Democrat, is hoping to present evidence that at least 28 signers were wrongfully excluded, thus giving him enough signatures to make a run.

With 250 approved signatures needed, only 222 of Morrissey’s 972 were accepted on March 31, making him ineligible for the June primary.

Sen. Rosalyn Dance, D-Petersburg, and Del. Joseph Preston, D-Petersburg are currently on the ballot for the Democratic primary.

If Morrissey’s lawsuit fails, he could run as an Independent candidate.
