Henrico man sentenced in HIV case involving 2 Md. women

BETHESDA, Md. – A judge ordered a Henrico man who had sex with women in Maryland without telling them he had HIV to stop having unprotected sex during  during his sentencing hearing Monday.

WJLA reports that report 28-year-old Daniel Cleaves was sentenced to 18 months behind bars, but the judge gave him credit for the 157 days he has already spent in jail.

Cleaves sobbed as his parents pleaded with the judge to let him off on the time he has already served, according to WJLA.

Court documents revealed a text message exchange between Cleaves and one of the victims:

Victim: I can’t believe you didn’t tell me. I’m crying and don’t feel like living anymore.

Cleaves: I should’ve told you. I’m truly sorry.

Earlier this month, Cleaves pleaded guilty to reckless endangerment, but said he was taking drugs that would have made HIV transmission highly unlikely.

“Dan recognizes, most of all that because he felt the same pain that these victims felt, that he is going to remember that if he ever thinks about doing this again” said Andrew Jezic, Cleaves’ defense attorney.

However, Ramon Korionoff, of the Montgomery County State’s Attorney’s Office, argued that Cleaves denied his victims the choice of whether they wanted to engage with sexual behavior with them.

The two Maryland women Cleaves had sex with have both tested negative for HIV.

The law does not require Cleaves, who faces similar charges in the Richmond area, to register as sex offender.
