VIDEO: Fla. judge to public defender, ‘I’ll beat your ***’

BREVARD COUNTY, Fla. — Things got very heated between a judge and a veteran public defender in a Florida courtroom Monday.

Judge John Murphy is heard on the surveillance camera using an expletive to describe how he will beat up veteran public defender Andrew Weinstock.

“You know, if I had a rock I would throw it at you right now,” Murphy said. “Stop pissing me off. Just sit down.”

WFTV reports that in happened when the judge was pressuring Weinstock to get his client to waive his right to a speedy trial.

“You know I’m the public defender. I have a right to be here and I have a right to stand and represent my client,” Weinstock said in the video.

“If you want to fight, let’s go out back and I’ll just beat your ass,” Murphy said just before the pair are seen walking out of the courtroom.

Weinstock’s supervisor said the public defender thought they were going to talk it out in the hall, but says the judge threw punches at him.

“The attorney said that immediately upon entering the hallway he was grabbed by the collar and began to be struck,” said Blaise Trettis, public defender of the 18th Judicial Court. “There was no discussion, no talk, not even time for anything. Just as soon as they’re in the hallway, the attorney was grabbed.”

The judge was not arrested, and it does not appear charges will be filed.

However, the public defender’s office said the incident will be reported to the Florida Bar.

    Those guys probably have been knowing each other for years and appeared in court numerous times. Folks have no clue as to the dynamics of the relationships between lawyers and judges. They put on good shows during trials but at the conclusion, they joke with each other and have a totally different relationship. In this case, however, they let it become personal instead of maintaining their professionalism before the public. That’s probably why they didn’t press charges against each others.

      Maintain impulse control.
      You’re making the same mistake the judge made……..letting emotions rule over intellect…. but perhaps I’m giving you too much credit for intellectual abilities.

      First of all, don’t yell.
      Second of all, I DO have the right, he is a VERY public figure.
      He and he alone is responsible for his behavior and the unintended consequences which may follow.
      I, on the other hand am NOT a public figure, you ignorant imbecile.

    Although Murphy was voted in office, Florida law does not allow for a recall election.
    Florida judges may be removed in one of two ways:

    On the recommendation of the judicial qualifications commission, the supreme court may discipline, retire, or remove a judge.
    OR
    Judges may be impeached by a two-thirds vote of the house of representatives and convicted by a two-thirds vote of the senate.

    Or, with enough public pressure, he can be compelled to
    resign.

    W, I agree with you they let emotions get the best of them and they both should deal with the consequences. They are public figures and that behavior is inexcusable.

    Because the wheels of Justice grind slowly, it will take some time for ‘due process’ to catch up to Murphy; and that is assuming the FLORIDA JUDICIAL QUALIFICATIONS COMMISSION follows through with an investigation and a ruling against him. Ditto for the FLORIDA BAR.
    So, by citizens putting enough heat on him, he will resign.

      While I’m not convinced of the legality of your claims to have the right to post the home address of a judge I feel that it is not the wisest thing to do – you’ve possibly put his family in danger by doing so. Not cool W, not cool at all.
