Mother accused of murdering newborn out on bond

DINWIDDIE COUNTY, Va. (WTVR) -- A Dinwiddie Circuit Court judge is allowing the mother accused of murdering her newborn to walk free.

Tuesday morning it took that judge a matter of minutes to grant Devin Small a $20,000 bond.

The 22-year-old is accused of giving birth in the bathroom of her home along the 18000 block of Namozine Road at the end of September.

Investigators said the baby was still inside the toilet when emergency crews arrived at the home.

But the other big part to this story centers around Devin Small's mother, Angela, who was also charged with first degree murder in the case. In a surprising twist, Angela died Sunday from a heart attack while out on bond. The judge is allowing Angela's $20,000 bond already posted, to now be used by Devin.

After paperwork is signed, Devin's attorney Joe Morrisey expects his client to walk free. Morrisey told CBS 6 reporter Jerrita Patterson, Devin was granted bond because the newborn's autopsy report has not been completed.

Law enforcement sources said there were others inside the home at the time of the child's birth. Each failed to remove the newborn from danger, the sources added.

Devin Small is scheduled to return to court March 25 at 10 a.m.
