RICHMOND, Va. (WTVR) - The man convicted in the 2006 New Year's Day murders of the Harvey family in South Richmond will have his appeal heard this week. A federal appeals court is scheduled to hear Ricky Gray's case Wednesday.

Gray was sentenced to death for murdering the two Harvey children, Stella, 9, and Ruby, 4. Gray was also sentenced to two life prison terms for murdering parents Bryan and Kathryn Harvey. All four were killed in the family's Woodland Heights home.

If Gray loses his appeal the attorney general is expected to ask for an execution date to be set.

Gray and accomplice Ray Dandridge set the Harvery's home on fire after the murders. They were later arrested in Philadelphia.

Dandridge is serving life in prison after he was convicted in the murders of another Richmond family.
