LYCOMING, Pa. (WTVR)—Ty Levy, the 49-year-old former Henrico teacher and tennis coach convicted of sex abuse and unlawful contact with a minor, was re-sentenced by a judge today.
A district attorney in Pennsylvania recently asked a judge to reconsider the sentence handed down for Levy, because he considered it too lenient.
Levy was originally sentenced this year to time served, 16 months. This meant he would have been soon released from jail. He would have then returned to Henrico to serve six years supervised probation.
Today Levy was re-sentenced and the judge gave him 30 months to 10 years in a state prison. The minimum is 30 months (minus the credit for time served). The maximum is 10 years if he does not successfully complete rehabilitation programs or is a bad prisoner.
The incarceration period is for all of the charges that he was found guilty of that were previously reported.
Levy will get credit for the time served so far, which is 17 months. The new sentence basically equals an additional 13-month state prison sentence.
Levy’s attorney and family lobbied for sex offender counseling in Virginia, but the judge said it was Levy’s responsibility to deal with the charges and not leave it in the hands of Virginia authorities.
Levy was found guilty of two counts of sexual abuse of children and four counts of unlawful contact with a minor. The Sun Gazette reported that Levy arranged inappropriate online video chats with a 15-year-old South Williamsport girl in December 2009.
Levy was arrested on June 23, 2011.
