SportsQuest reaches nearly $1 million settlement with AG’s Office

CHESTERFIELD COUNTY, Va. (WTVR) – The SportsQuest complex in Chesterfield County will pay out more than $900,000 in restitution, attorneys fees, and  civil penalties, as part of a lawsuit settlement with the Attorney General’s Office.

The suit alleges SportsQuest violated the state’s Health Spa Act by pre-selling contracts for a facility near 13050 Genito Road in Midlothian that it failed to open within a year of the first membership pre-sale.

According to the suit, the complex also failed to pay out refunds to customers within thirty days of  closing another facility at 2240 Oak Lake Boulevard in Midlothian.

A press release from the Attorney General’s Office states, ” the commonwealth will be granted a permanent injunction prohibiting SportsQuest from engaging in further violations of the Virginia Health Spa Act;judgment against SportsQuest in the amount of $900,214, which, if collected, will be used for restitution to affected consumers; judgment against SportsQuest in the amount of $50,000 for civil penalties; and judgment against SportsQuest in the amount of $45,800 for attorney’s fees and costs.”

The Attorney General’s Office says customers who had memberships with SportsQuest should contact the Virginia Department of Agriculture and Consumer Services, if they haven’t already done so,  for details on filing a claim for a refund.

SportQuest filed for bankruptcy in May and had their property auctioned off, the result of owing more than $7 million to creditors.
