RICHMOND, Va. (WTVR) – Court documents obtained by CBS 6 show attorneys for the man accused in the July 29 hit and run death of bicyclist Lanie Kruszewski may use an alibi defense in court.

After Kruszewski’s death, Eli Webb came forward and told police he was driving an SUV on River Road the night of the incident, but said he thought he’d hit a deer.

CBS 6 Legal Analyst Todd Stone said the court document don’t necessarily mean the defense will try to convince a jury Webb hit a deer, but it gives them the legal option to mount an alibi defense.

Webb is out on bond and has another court hearing scheduled for October 12.
