Huguely’s lawyers ask for change of venue

CHARLOTTESVILLE, Va (WTVR) – Lawyers for the former University of Virginia lacrosse player convicted earlier this year of murdering his ex-girlfriend are asking a judge that a civil case being brought against their client not be tried in Charlottesville.

George Huguely’s attorneys filed the motion yesterday. According to WCAV, the Charlottesville CBS affiliate, the lawyers claim local prejudice would prevent a fair and impartial trial.

The motion also claims there isn’t enough evidence to support  allegations that Huguely acted with “conscious disregard” in the may 2010 incident.

The victim’s mother, Sharon Love, filed the $30 million civil suit against Huguely in April.    She’s also suing the state and the University of Virginia, saying they knew Huguely had a troubled past, and did not do enough to prevent her daughter Yeardley’s death.

Last week Huguely’s lawyers asked the judge to dismiss their clients February convictionof 2nd degree murder and grand larceny. His defense team claims the prosecutors knew Love planned to file the civil suits, and therefore should not have allowed her or her surviving daughter to testify in the trial.
