‘Zoloft defense’ won’t stick, ex-cop found guilty of rape and more

A jury rejects a former police detective’s defense that he was blacked out when he allegedly raped a waitress.

Despite the defense argument that such an “assault ran counter to a life spent protecting community and country,” the ex-cop was found guilty on all charges.

Today the jury rejected the “Zoloft defense,” used by former Westminster police detective accused of raping a waitress, according to the Los-Angeles Times, and found the defendant guilty of all seven charges.

The jury, of eight women and four men, found Anthony Nicholas Orban , a Marine veteran of the Iraq War, guilty of two counts of rape, two counts of forced oral copulation, two of sexual penetration with a foreign object, one count of making a criminal threat, and a sentence enhancement of using a firearm in commission of a kidnapping.

Orban’s defense attorney had said that Orban was not “unconscious” because of Zoloft and therefore not responsible.

The woman, age 25 at the time of the act, testified that Orban forced a loaded gun into her mouth and threatened her.
