City of Lexington asks judge to dismiss lawsuit claiming first amendment violation

[ooyala code=”d3d2cxNToVjLs7JzMYUGCL0BD_TcNfrN”](WTVR) – The city of Lexington and The Sons of Confederate Veterans are waiting on a federal ruling that will determine whether a lawsuit against the city will be dismissed.

On Monday the City of Lexington requested a judge dismiss a lawsuit filed by the group that claims an ordinance prohibiting flying confederate flags violates the first amendment.

The city ordinance limits flags flown on city flag poles to city, state, and national flags.

The Sons of Confederate veterans argues that the city council only imposed the ordinance because it doesn’t like the confederate flag and group.

The judge says he will rule with in the next two weeks.
