Thomas Haynesworth on Brian Banks, Bennett Barbour

A California woman who falsely accused a high school football player of rape, sending him to prison for five years, is unlikely to face charges.

Prosecutors said Friday they have no plans to charge Wanette Gibson. In 2002 she accused Brian Banks of rape, but admitted to a private investigator last year she had lied about the whole thing.

A judge dismissed Banks' conviction Thursday.

Closer to home, the Virginia Supreme Court cleared the name of a Charles City County man wrongly convicted of a 1978 rape in Williamsburg.

In this case, a woman mistakenly identified a man named Bennett Barbour as her attacker. But in 2010, the 56-year-old was cleared by new DNA evidence.

Only two other men, besides Barbour, have been granted writs of actual innocence by the Virginia Supreme Court. Thomas Haynesworth is one of them. He spent 27 years behind bars for rapes he did not commit.
