RICHMOND, Va. (WTVR) – Prosecutors decided Wednesday not to move forward with burglary charges against three men accused of breaking into the apartment of a missing man, whose body was eventually found in the Kanawha Canal.

The conspiracy to commit burglary charges against Tre Carrington, 24, Eric Finger, 22, and Andrew Scott, 21, have been nolle prossed. Back in December, police said the three men were seen stealing electronics from Matthew Williams’ apartment on the same night of his disappearance.

The court made it clear that the three men had nothing to do with Williams’ death. Williams’ body was pulled from the canal in early January, ending a weeks-long search for the 23-year-old, North Carolina native. Police say his death was accidental.

WTVR.com spoke with Scott’s attorney, James Bullard Jr., moments after Wednesday’s court proceedings.

“It’s an unfortunate situation, and at this point, he’s [Scott] is looking to get the situation under control and behind him,” said Bullard. “Obviously he’s saddened by the death of that young man, and he obviously had nothing to do with that… As I said, the charges can be brought back and we’re preparing for any contingencies at this point.”
